Memorandum for His Excellency the Governor

I have carefully considered the case
of the condemned criminal Albert
Williams, alias Deeming, as presented
by Mr. Marshall Lyle in his letter
of the 17th instant addressed to His
Excellency.

The question submitted by the
Solicitor for the defence is analogous
to the case of the convict Colston,
upon which I tendered advice to
His Excellency at the time. A copy
of my opinion in that case is attached.

[crossed out: case is made out, or that any
fresh facts, or circumstances, are brought
to light, which would warrant, or
justify, me in recommending any
departure from the course followed
in Colston's case.]

Mr Lyle does not appear to
me to have made out a case to justify
the Governor in Council suspending
the execution of the convict Williams.
