the power to deal with it. I am also
of opinion that Mr Dana may, if the
offender be taken in or near Melbourne,
order the confinement of the Culprit in
the Melbourne Watchhouse. If the offender
be not taken in or near Melbourne, the
Culprit should be handed over to Mr
Danas own prison.

I have the honor to request that
your Honor will be pleased to ob-
tain for my guidance the opinion
of the Law Officer of the Crown, as
to whether, I as a [error omitted] District
Magistrate have authority to con-
fine in either of the Melbourne
Watchhouses men of the Native police
who have either deserted or otherwise
misconducted themselves, until such
times as they can be forwarded to the
Police Station at Narre Narre Warren.
