
the County Constables to lodge the prisoner together
with the Warrant at the Eastern hill Watch house
deeming that place more secure than my
own residence, intending to forward the
prisoner to Capt Danna’s Station: unless he came
to Melbourne the following day:
On Wednesday the 24th Inst I attended the Police
Office at 10 oclock A. M. and requested the
Town Chief Constable should the sitting Magistrates
during my absence inquire about the prisoners
that he would produce the Warrant. I also accquanted
him that should Capt Danna not appear at
the police office that day I must forward
the prisoner by Escort to Narra Narra Warren
in the terrms of the Warrant; my duty then
called me to the Crown Solictors Office
I returned to the Police Office at a
quarter before Eleven. A.M, and was informed
by Mr. Sugden, that, Henry Condell and
Benjemin Heape Esqr. J.Ps. had discharged
prisoner: I replied why did you bring
the prisoner before them contrary to
the Warrant, Mr. Sugden stated that
the above named Gentlemen ordered and
directed the prisoner to be brought before
them, and he was not to dispute these
orders, I there trust and respectfully hope
that Your Worship will not consider I have
remiss or negligent in my duty
