Advice to Agencies
Bushfire Royal Commission

A Royal Commission has been established to inquire into and report on the causes and circumstances of the bushfires which burned in various parts of Victoria in late January and in February 2009.

Agencies should be aware that the Royal Commission may request that certain documentation be made available in relation to the terms of reference of the Commission. For this reason I bring to your attention the need to consider carefully the disposal of any records for which you are responsible, and that may be required by the Commission, during the course of the Commission itself.

In addition, you should note that it is possible that some of your records may be required for any legal action that may take place during or after the Royal Commission. I refer you to the Crimes (Document Destruction) Act 2006 and our Advice 18 to agencies on this matter.
